Canada’s Artificial Intelligence and Data Act (AIDA, in Bill C-27) — died with the session and never came into force

An Act to enact the Consumer Privacy Protection Act, the Personal Information and Data Protection Tribunal Act and the Artificial Intelligence and Data Act and to make consequential and related amendments to other Acts (short title: Digital Charter Implementation Act, 2022)

House Government Bill sponsored by the Minister of Innovation, Science and Industry; 44th Parliament, 1st session · Bill C-27, 44th Parliament, 1st session

The sole purpose of this entry is to correct an error that recurs in market materials: AIDA is not in force. It was Part 3 of Bill C-27, bundled with the Consumer Privacy Protection Act that would have replaced PIPEDA and with the Personal Information and Data Protection Tribunal Act. The bill received first reading on 16 June 2022 and second reading and referral to committee on 24 April 2023, then remained at committee stage until the 44th Parliament’s 1st session ended on 6 January 2025 and it died without Royal Assent. Three consequences matter commercially. First, Canada has no horizontal federal AI statute in force and no statutory “high-impact system” duties derived from AIDA. Second, PIPEDA and the ten fair information principles in its Schedule 1 remain the operative federal private-sector rules, so AI compliance hooks come from privacy, consumer protection, human rights and sectoral regulation rather than AIDA. Third, provincial law already imposes concrete enforceable duties on automated decisions — notably section 12.1 of Québec’s Law 25 — so design to provincial law rather than to a lapsed federal bill when entering the Canadian market.

Does this apply to me?

This entry creates no current obligation. It has three practical uses for a Chinese AI company: (1) in investment diligence, customer questionnaires and tender documents, never describe AIDA as an AI law in force in Canada or claim “AIDA compliance”; (2) design the Canadian AI compliance baseline around PIPEDA federally, provincial privacy statutes (notably Québec’s Law 25 and the Alberta and British Columbia statutes), and applicable sectoral regulation; (3) keep tracking the 45th Parliament for successor AI legislation and re-assess when a text appears, since the high-impact system framework may return in a new form — and track Bill C-36, now at second reading, which is not AI legislation but would rewrite the privacy baseline you build on in Canada.

Application timeline

  1. 2022-06-16

Bill C-27 receives first reading (containing AIDA)

LEGISinfo records first reading completed on 16 June 2022.

  2. 2023-04-24

Second reading and referral to committee; no further progress

LEGISinfo records the latest activity as second reading and referral to committee on 24 April 2023; the status remained “At consideration in committee in the House of Commons”.

  3. 2025-01-06

The 44th Parliament’s 1st session ends; the bill dies and AIDA never comes into force

LEGISinfo records the 44th Parliament, 1st session as running from 22 November 2021 to 6 January 2025. A bill still in committee when the session ends dies and must be reintroduced in a new session. Canada therefore has no horizontal federal AI statute in force.

  4. 2025-05-26

The 45th Parliament’s 1st session begins; as at the retrieval date the session contains no bill regulating artificial intelligence

The LEGISinfo overview page records the current session as the 45th Parliament, 1st session, from 26 May 2025 to the present. This review used the LEGISinfo bill-list data endpoint (the source behind the web search, so unaffected by client-side rendering) to retrieve all 185 bills of the session — C-1 to C-37, private members’ bills from C-201, and 57 Senate S- bills — and searched every long title and short title: none regulates artificial intelligence. The only privacy-related government bill is C-36 (enacting the Protecting Privacy and Consumer Data Act and amending PIPEDA), whose long title contains no AI statute. So as at 12 September 2026 Canada has neither a horizontal federal AI statute in force nor an AIDA successor before Parliament.

Penalties

Not applicable: the bill never came into force and creates no enforceable penalties.

Known uncertainty

(1) Confidence is high on both facts: that AIDA is not in force (LEGISinfo shows the session end date and the committee-stage status) and that the 45th Parliament’s 1st session contains no AI bill (every title among the session’s 185 bills was searched in this review). (2) The search covered long titles and short titles only; a bill carrying AI provisions in its body without saying so in its title would not be caught, so the finding is “no bill regulating artificial intelligence”, not “no AI provisions anywhere”. (3) The finding is time-sensitive: the bill list moves as the session proceeds, so re-check the current LEGISinfo list before citing externally. (4) Always cite the Parliament number: the 45th Parliament, 1st session has its own Bill C-27 (the Tlegohli Got’ine self-government bill), entirely unrelated to the 44th Parliament’s C-27 that carried AIDA — “Bill C-27” alone is now ambiguous enough to mislead.
