EU implementing regulation on type-approval of the automated driving system (ADS) of fully automated vehicles

Commission Implementing Regulation (EU) 2022/1426 laying down rules for the application of Regulation (EU) 2019/2144 as regards uniform procedures and technical specifications for the type-approval of the automated driving system (ADS) of fully automated vehicles

European Commission · Commission Implementing Regulation (EU) 2022/1426,经第 (EU) 2026/481 号实施条例修订

This is currently the only EU legislation dedicated to type-approving the automated driving system of fully automated, unsupervised vehicles. It applies to categories M and N for three use cases: carriage of passengers or goods on a predefined area, hub-to-hub carriage on a predefined route with fixed start and end points, and automated valet parking (AVP). It covers vehicles operating without driver supervision and dual mode vehicles that have a driver seat and can switch between manual and fully automated mode, with transitions permitted only at standstill; as amended by Implementing Regulation (EU) 2026/481 the AVP use case is no longer confined to dual mode vehicles and instead covers vehicles with an ADS feature for parking applications within an ODD. Approval rests on three annexes: the Annex I information document entries, the Annex II technical specifications and the Annex III assessment method, with AVP features additionally subject to Annex V. The Annex III compliance assessment has five parts: the traffic scenarios to consider; assessment of the ADS safety concept and audit of the manufacturer safety management system; tests for the most relevant traffic scenarios; credibility assessment principles for using a virtual toolchain in ADS validation; and the system established by the manufacturer to ensure in-service reporting. The Regulation also defines the operational design domain (ODD) and unreasonable risk as an overall risk level increased compared with a manually driven vehicle in comparable transportation services and situations within the ODD.

Does this apply to me?

A Chinese company is caught when it places unsupervised vehicles — robotaxis, driverless shuttles, delivery robots, port or campus autonomous vehicles — on the EU market and seeks type approval; when it deploys fleets with an EU transport service operator, defined in the Regulation as the entity providing a transport service using one or more fully automated vehicles; when, as an ADS supplier to an EU vehicle manufacturer, it must deliver the safety concept, scenario catalogue, virtual validation toolchain credibility evidence and in-service reporting interface; and when it runs remote assistance or remote monitoring centres for exported vehicles. Vehicles operating only on Chinese pilot roads are out of scope, but the scenario catalogue and safety argumentation can be reused provided the EU-side evidence is restructured to Annex III.

Application timeline

  1. 2022-09-15

Implementing Regulation enters into force (twentieth day after OJ publication)

From this date the EU can issue EU type-approval certificates for the ADS of fully automated vehicles under uniform procedures; whole-vehicle approval additionally requires the conditions in Annex II Part I Appendix 1 to Regulation (EU) 2018/858.

  2. 2026-03-24

Implementing Regulation (EU) 2026/481 enters into force: the small-series limit is lifted for automated valet parking and Annex V is added

The amending Regulation was adopted on 3 March 2026, published at OJ L, 2026/481, 4.3.2026 and entered into force on the twentieth day after publication, 24 March 2026. Key points: (1) the AVP use case in Article 1(c) is broadened from dual mode vehicles to "vehicles with an ADS feature for parking applications within an ODD"; (2) the recitals record that the small-series scheme in place since 2022 applies on condition that registrations of a vehicle type in the Union do not exceed 1 500 per year, and lift that limitation for the AVP use case, opening unlimited-series whole-vehicle type approval for vehicles equipped with AVP systems; (3) a new subparagraph in Article 3(2) subjects AVP features to the technical specifications in the new Annex V, assessed under Annex V; (4) the definitions in Article 2(2), (5) and (6) (ADS feature, operational function, tactical function) are rewritten to align with the UNECE framework; (5) Annex III is amended. Annex III still has five parts.

Obligations (3)

Each states its trigger, the evidence to retain and the clause it comes from

Prepare the Annex I information document entries for the ADS type-approval application

Severity HighArt. 3(1);Annex I

The relevant entries of the information document submitted with the type-approval application under Article 24(1)(a) of Regulation (EU) 2018/858 must consist of the information for the ADS set out in Annex I. In practice this means describing, in a format the authority can check, the ODD boundaries, system architecture, perception and decision chain, degradation strategy, remote assistance interface and dual-mode transition conditions.

Applies when
Manufacturers seeking ADS type approval and their EU representatives.
Evidence to retain
  • · ADS information document structured to the Annex I entries
  • · ODD boundary definition and exit condition description
  • · System architecture diagram and inventory of safety-relevant interfaces
  • · For dual mode vehicles, design and test evidence that mode transitions occur only at standstill

Estimated first-time effort: 15–40 person-days (estimate, not a commitment)

Meet the Annex II technical specifications and pass the five-part Annex III assessment

Severity CriticalArt. 3(2)(含 2026/481 新增第二款);Annex II;Annex III Parts 1–4;Annex V(AVP)

ADS type approval is subject to the Annex II technical specifications, assessed by the approval authority or its technical service in accordance with Annex III; as amended by Implementing Regulation (EU) 2026/481, Article 3(2) adds a second subparagraph subjecting the type approval of automated valet parking (AVP) features to the Annex V technical specifications, assessed under Annex V. The overall Annex III compliance assessment consists of five parts: the traffic scenarios to consider; assessment of the ADS safety concept and audit of the manufacturer safety management system; tests for the most relevant traffic scenarios; credibility assessment principles for a virtual toolchain used in ADS validation; and the system established by the manufacturer to ensure in-service reporting. Any Annex II requirement may be checked by tests performed by the approval authority or its technical service. Scenarios and parameters must be used where relevant to the ADS ODD; where the manufacturer deviates from the proposed parameters, the safety performance metrics and inherent assumptions used must be documented in the documentation package and shown to be adequate.

Applies when
Manufacturers and their ADS suppliers; teams relying heavily on virtual validation must prepare dedicated toolchain credibility evidence.
Evidence to retain
  • · Scenario catalogue with ODD relevance justification, including safety performance metrics and assumptions where proposed parameters are not followed
  • · ADS safety concept document and safety management system audit records
  • · Physical test plan and test reports for the most relevant scenarios
  • · Credibility assessment report for the virtual simulation toolchain (model verification, validation and uncertainty analysis)
  • · Technical service findings list and closure records

Estimated first-time effort: 80–240 person-days (estimate, not a commitment)

Establish an in-service monitoring and in-service reporting system

Severity HighArt. 2(9)–(10), Art. 2(35);Annex III Part 5

The Regulation separates two concepts: in-service monitoring means data collected by the manufacturer and data from other sources to obtain evidence on the in-service safety performance of the ADS in the field; in-service reporting means data reported by the manufacturer to demonstrate that safety performance. Part 5 of Annex III makes the system established by the manufacturer to ensure in-service reporting part of the compliance assessment, so it must be auditable at type approval rather than built after launch.

Applies when
Manufacturers and transport service operators; where data returns from the EU to China for analysis, cross-border transfer compliance must be handled in parallel.
Evidence to retain
  • · Inventory of in-service monitoring data items, their sources and collection methods
  • · Design document for the in-service reporting system (content, frequency, accountable owner)
  • · Data quality control and anomaly detection procedures
  • · Data provision and responsibility allocation agreement with the transport service operator
  • · Legal assessment record for cross-border data transfers

Estimated first-time effort: 20–60 person-days (estimate, not a commitment)

Penalties

The Implementing Regulation itself sets no penalties; enforcement runs through the type-approval and market surveillance machinery of Regulation (EU) 2018/858 — approval is refused where the technical specifications or assessment requirements are not met, and post-approval non-conformity can trigger corrective measures, recall and withdrawal of the approval.

Known uncertainty

The follow-up legislation on unlimited-series whole-vehicle approval **has partly landed but covers only one use case**: Implementing Regulation (EU) 2026/481, in force from 24 March 2026, lifts the 1 500-registrations-per-year small-series cap for the automated valet parking (AVP) use case only, while the predefined-area and hub-to-hub use cases continue under the small-series scheme; this entry draws no conclusion on when the cap might be lifted for those two. The Annex II specifications, Annex III Parts 1, 3 and 4 and the new Annex V contain many detailed parameters; this entry records only the structure and the obligation framework and does not restate figures, so the consolidated text CELEX:02022R1426-20260324 must be checked clause by clause before implementation.
