FDA Predetermined Change Control Plans (PCCP) for AI-enabled devices

FDA final guidance "Marketing Submission Recommendations for a Predetermined Change Control Plan for Artificial Intelligence-Enabled Device Software Functions" (statutory basis: section 515C of the FD&C Act, 21 U.S.C. 360e-4)

U.S. Food and Drug Administration · 89 FR 96259; Docket No. FDA-2022-D-2628

The PCCP addresses the central commercial question for AI devices: whether every model iteration needs a new submission. Under section 515C and this final guidance, a sponsor can include a predetermined change control plan in a marketing submission (510(k), De Novo or PMA) describing the planned modifications to the AI-enabled device software functions, the associated methodology to develop, validate and implement those modifications, and an assessment of their impact. FDA reviews the PCCP as part of the marketing submission so that each modification later implemented within the plan needs no additional marketing submission, while the device remains safe and effective. The final guidance also recommends what PCCP information to include in labelling and publicly available decision summaries, how to implement modifications consistent with an authorised PCCP, and postmarket surveillance.

Does this apply to me?

A Chinese medical AI company is in scope when it files a 510(k), De Novo or PMA to market AI-enabled imaging, pathology, ECG, fundus or ultrasound software in the United States; when it plans post-market retraining on new data, expansion of the indicated population or supported device models, threshold adjustments or changes to input imaging protocols; when U.S. hospitals or distributors require an explanation of how model updates stay compliant; and when it supplies AI modules as an OEM to a U.S. submission holder, which will write the PCCP boundary into supply and change notification terms. Modifications outside an authorised PCCP still require a new marketing submission, which is a hard constraint on product roadmap scheduling.

Draft guidance published (88 FR 19648)

The draft was titled "Marketing Submission Recommendations for a Predetermined Change Control Plan for Artificial Intelligence/Machine Learning (AI/ML)-Enabled Device Software Functions"; FDA revised it and changed the title in response to comments.

  3. 2024-12-04

Final guidance issued (89 FR 96259)

The final guidance clarifies the scope, the PCCP information to include in labelling and publicly available decision summaries, implementation of modifications consistent with an authorised PCCP, and postmarket surveillance recommendations, aligns the definitions of artificial intelligence and machine learning with Executive Order 14110 of 30 October 2023, and clarifies the terminology for training, tuning and test data.

  4. 2025-01-07

Lifecycle management draft guidance published (90 FR 1154, still draft)

The draft "Artificial Intelligence-Enabled Device Software Functions: Lifecycle Management and Marketing Submission Recommendations" addresses lifecycle management and marketing submissions for AI devices; as at 12 September 2026 no finalising notice was found, so it should be treated as draft.

Obligations (4)

Each states its trigger, the evidence to retain and the clause it comes from

Include the three PCCP elements in the marketing submission

Severity HighFD&C Act §515C (21 U.S.C. 360e-4);89 FR 96259

Include a PCCP in the marketing submission for a device with one or more AI-enabled device software functions. It should describe the planned AI-DSF modifications, the associated methodology to develop, validate and implement those modifications, and an assessment of the impact of those modifications. FDA reviews the PCCP as part of the marketing submission, so the plan boundary must be specific enough to be reviewable yet broad enough to cover foreseeable iteration needs, and the terminology for training, tuning and test data should follow the clarifications in the final guidance.

Applies when
Sponsors filing a 510(k), De Novo or PMA for a device that includes AI-enabled device software functions.
Evidence to retain
  • · PCCP document covering the planned modification list, methodology and impact assessment
  • · Modification boundary criteria and the test for when a new submission is required
  • · Description of training, tuning and test data splits with the data dictionary
  • · Validation protocol and acceptance criteria, including the no-performance-degradation threshold
  • · FDA review correspondence (additional information or deficiency letters) and responses

Estimated first-time effort: 25–70 person-days (estimate, not a commitment)

Include PCCP information in labelling and in publicly available decision summaries

Severity Medium89 FR 96259(最终指南对标签与公开决策摘要的澄清)

One of the clarifications the final guidance makes over the draft concerns the PCCP information to include in labelling and in publicly available decision summaries. In practice the labelling must let users know that an authorised change plan exists, what types of change may occur and how to identify the current version, and the wording in the public decision summary must match the submission so that external marketing does not overstate what automatic updating means.

Applies when
Holders of an authorised PCCP and their marketing and medical affairs teams.
Evidence to retain
  • · Final labelling and instructions for use containing the PCCP description, with version records
  • · Consistency check between the PCCP wording in the public decision summary and the submission
  • · Compliance review records for promotional materials
  • · Evidence of how users can identify the current software version

Estimated first-time effort: 5–15 person-days (estimate, not a commitment)

Implement modifications only consistent with the authorised PCCP and retain the evidence

Severity Critical89 FR 96259(按已获授权 PCCP 实施修改)

The effect of FDA review and authorisation of a PCCP is that no additional marketing submission is needed for each modification implemented within the plan. Companies therefore need a gating process confirming, for every release, that the intended modification falls within the authorised modification list and methodology and that validation was performed as specified; anything outside must return to the marketing submission route. The final guidance specifically clarifies implementation of modifications consistent with an authorised PCCP, and the implementation evidence must be retrievable during inspection.

Applies when
The R&D, quality and regulatory teams of the submission holder; changes in OEM-supplied modules must enter the same gate.
Evidence to retain
  • · Per-release determination of whether the change is within the PCCP scope
  • · Validation reports executed under the PCCP methodology with performance comparison data
  • · Release approval records and sign-off
  • · Marketing submission records for out-of-scope modifications
  • · Traceability register for model and data versions

Estimated first-time effort: 15–45 person-days (estimate, not a commitment)

Conduct postmarket surveillance for the AI device as recommended by the final guidance

Severity High89 FR 96259(上市后监督建议)

The final guidance adds clarifications on postmarket surveillance relative to the draft. For an AI device this means monitoring real-world performance continuously while the PCCP is in force, detecting distribution shift, subgroup performance differences and degradation, and feeding the findings back into decisions on further modifications and risk controls. The system must connect to the device quality system and adverse event reporting processes.

Applies when
Holders marketing AI devices in the United States, including Chinese manufacturers filing through a U.S. agent.
Evidence to retain
  • · Real-world performance monitoring plan and metric definitions, including subgroup stratification
  • · Legal basis and privacy compliance analysis for the monitoring data collection
  • · Thresholds, alerts and response records for performance degradation and data drift
  • · Records showing monitoring findings driving modification decisions and risk control updates
  • · Documented interface with the adverse event reporting process

Estimated first-time effort: 15–45 person-days (estimate, not a commitment)

Penalties

The guidance itself creates no penalties, but implementing a modification outside an authorised PCCP amounts to changing the device without the corresponding marketing authorisation, which can support misbranding or adulteration findings under the FD&C Act and the associated enforcement (warning letters, import detention, recalls). The actual consequence depends on the nature of the modification and FDA case-by-case judgement.

Known uncertainty

This entry is verified against the Federal Register notices (89 FR 96259 and 90 FR 1154); the guidance PDFs themselves were not reviewed page by page, so no template sections, examples or recommended formats from the guidance are stated here, and the full FDA guidance must govern when a PCCP is actually drafted. FDA guidance is non-binding and expressed as recommendations, with section 515C as the statutory basis, and the lifecycle management guidance remained a draft as at the review date and must not be cited as a final requirement.
