New York City Automated Employment Decision Tools law (Local Law 144 of 2021)

Local Law 144 of 2021 regarding automated employment decision tools

New York City Council / NYC Department of Consumer and Worker Protection (DCWP) · NYC Local Law 144 of 2021;纽约市消费者与劳工保护局规则

The local law prohibits employers and employment agencies from using an automated employment decision tool unless three conditions are met together: the tool has been subject to a bias audit within one year of its use; information about that bias audit is publicly available; and the required notices have been provided to employees or job candidates. DCWP clarified in its June 2023 revised presentation materials that the notice must be provided 10 business days before use of the tool. DCWP accepts public complaints, including for failure to obtain the required bias audit, failure to post a summary of the audit results and failure to give the required notices.

Does this apply to me?

A Chinese company is caught when it: (1) recruits for New York City roles using automated resume screening, video interview scoring, gamified assessment or algorithmic ranking, in which case the employer must obtain the audit, publish the summary and give notice 10 business days in advance, whether the tool is built or bought; (2) uses algorithmic tools to decide promotions for New York City employees, which triggers the same duties; or (3) supplies such tools to U.S. customers recruiting in New York City, where customers require historical selection data for the audit, cooperation with the independent auditor and allocation of audit cost, and a vendor unable to produce subgroup statistics frequently loses the account outright.
