Cybersecurity Law

Cybersecurity Law of the People’s Republic of China (as amended in 2025)

Standing Committee of the National People’s Congress · 2016年11月7日第十二届全国人大常委会第二十四次会议通过,根据2025年10月28日第十四届全国人大常委会第十八次会议《关于修改〈中华人民共和国网络安全法〉的决定》修正

China’s foundational statute for cyberspace, amended by the NPC Standing Committee in October 2025. The core corporate duties sit in Chapter III: the five security obligations under the multi-level protection scheme (Art. 23(1)–(5), including retention of network logs for no less than six months); network products and services must meet mandatory national standards, with immediate remediation and reporting of vulnerabilities (Art. 24); certification or testing of critical network equipment and dedicated cybersecurity products (Art. 25); real-name authentication of users (Art. 26); and incident response plans and reporting (Art. 27). The amendment adds Art. 20, setting out state support for AI alongside ethics norms and security supervision.

Does this apply to me?

It applies to anyone building, operating, maintaining or using networks inside the PRC (Art. 2). Concrete triggers for AI companies: hosting a model service on domestic cloud makes you a network operator, requiring MLPS grading and filing plus retention of network logs for at least six months; offering users information-publishing or instant-messaging features — including the community and sharing functions inside conversational products — requires real-name authentication; selling AI appliances or robot controllers that fall within the catalogue of critical network equipment or dedicated cybersecurity products requires certification or testing before sale; and being designated a CIIO, or supplying one, brings procured network products and services that may affect national security within the cybersecurity review.

Each states its trigger, the evidence to retain and the clause it comes from

Discharge the five MLPS security obligations

Severity High第二十三条

Art. 23 enumerates five obligations: (1) adopt internal security management systems and operating procedures, name a cybersecurity officer and allocate protection responsibility; (2) deploy technical measures against computer viruses, network attacks and intrusions; (3) deploy technical measures to monitor and record network operating status and security events, and retain the relevant network logs for no less than six months; (4) apply data classification and backup and encryption of important data; and (5) perform any other duties set by law or administrative regulation. The aim is to keep the network free from interference, damage and unauthorised access, and to prevent network data from being leaked, stolen or tampered with. A CIIO carries the additional duties in Art. 36 on top of Art. 23.

Applies when
All network operators, including AI companies running inference services, internal R&D platforms and annotation platforms on domestic cloud.
Evidence to retain
  • · MLPS grading report, expert review opinion and public-security filing certificate
  • · MLPS assessment report and remediation closure records
  • · Appointment letter for the cybersecurity officer
  • · Security management policy and operating-procedure set
  • · Backup and encryption policy for important data, with drill records

Estimated first-time effort: 20–50 person-days (estimate, not a commitment)

Retain network logs for no less than six months

Severity High第二十三条第(三)项

Deploy technical measures to monitor and record network operating status and security events, and retain the relevant network logs for no less than six months. For a model service this must cover authentication and login logs, API call logs, and audit logs of administrative operations and data exports, with integrity and tamper-resistance assured.

Applies when
All network operators. This can be designed jointly with the six-month log requirement in Art. 9 of the AI Content Labelling Measures for content supplied without an explicit label.
Deadline: No less than six months.
Evidence to retain
  • · Log-collection scope note and field inventory
  • · Screenshots of the retention policy configuration showing the retention period
  • · Description of log integrity and tamper-resistance controls
  • · Records of sample log retrievals

Estimated first-time effort: 5–15 person-days (estimate, not a commitment)

Meet mandatory national standards and remediate vulnerabilities promptly

Severity High第二十四条、第二十五条

Network products and services must meet the mandatory requirements of the relevant national standards and must not contain malicious programs; on discovering a security defect or vulnerability the provider must take remedial action immediately, inform users as required and report to the competent authority. Providers must also maintain security support for their products and services and may not terminate it within the prescribed or agreed period. Where a product collects user information, the provider must disclose this and obtain consent.

Applies when
AI hardware and appliance vendors, robot and in-vehicle controller makers, and model vendors delivering software. Labelling of generated and synthetic content must conform to mandatory national standard GB 45438-2025.
Evidence to retain
  • · List of applicable mandatory national standards and conformity evidence
  • · Vulnerability management policy, SLA and remediation log
  • · Records of user notifications and reports to the competent authority
  • · Contract clauses on the security-maintenance period and the product lifecycle announcement

Estimated first-time effort: 10–30 person-days (estimate, not a commitment)

Authenticate the real identity of users of publishing and messaging services

Severity High第二十六条

When arranging network access or domain registration, handling fixed-line or mobile subscriptions, or providing users with information-publishing or instant-messaging services, the operator must require real identity information when signing the agreement or confirming the service; where the user does not provide it, the service must not be supplied.

Applies when
AI products with publishing, community, sharing or group-chat features; deep synthesis services are separately covered by the authentication requirement in Art. 9 of the Deep Synthesis Provisions.
Evidence to retain

Art. 61: a network operator failing the duties in Arts. 23 or 27 faces rectification orders, warnings and fines of RMB 10,000–50,000; refusal to rectify or harmful consequences raise this to RMB 50,000–500,000, with RMB 10,000–100,000 on responsible individuals. For CIIOs the bands rise to RMB 50,000–100,000, and RMB 100,000–1,000,000 on refusal to rectify. Serious consequences such as a large-scale data leak or loss of part of a CII’s functions attract RMB 500,000–2,000,000; especially serious consequences such as loss of a CII’s principal functions attract RMB 2,000,000–10,000,000, with RMB 200,000–1,000,000 on responsible individuals. Art. 64: failing real-name authentication attracts, on refusal to rectify or in serious cases, RMB 50,000–500,000 plus possible suspension of business, closure of the website or application, or revocation of permits or the licence.

Known uncertainty

What was retrieved is the consolidated amended text republished by the CAC on 29 Dec 2025 from npc.gov.cn; its header confirms the amendment was made under the NPC Standing Committee decision of 28 Oct 2025. However, Art. 81 of the consolidated text still records the original commencement date of 1 Jun 2017 and does not state when the amending decision itself took effect, and neither the decision nor the corresponding Presidential Order could be retrieved in this round. The timeline therefore records no commencement date for the amended provisions. Confirm the commencement date against the Presidential Order before relying on the amended provisions, in particular Art. 20 and the penalty bands in Art. 61.
